Speed Limits

These days one of the biggest concerns for UK motorists are Speeding Fines and Penalty Points. Sometimes it is because drivers become confused about what speed limit applies to a particular road. We all know about the 30 mph maximum speed limit on many roads but what many people do not realise is that this speed limit often does not need a 30 mph sign. Instead, such a limit is indicated (and must be obeyed) by the mere presence of a system of street lighting whereby the lampposts are no more than 200 yards apart. This can often lead to confusion on the part of drivers who believe that they were not exceeding the speed limit on the basis that no maximum speed sign was present. The bottom line is that it can be confusing and many motorists simply end up drifting over the 30 mph limit without immediately recognising that this is the speed limit in force at that particular point on the road. Indeed, there can be arguments raised as to whether or not a particular stretch of road complies with all aspects of the 'system of street lighting' test. This is why it is always a good idea to contact a specialist motoring lawyer - technical arguments can sometimes be raised as to whether a speed limit was in force at the point in question.

Another area of confusion can arise in relation to temporary speed limits. There are very strict requirements in respect of how, where and in what position, frequency and configuration the speed limit signs are placed. If you have received a notice of intended prosecution suggesting that you exceeded a temporary speed limit, take advice. If they get it wrong in relation to the signs on the road, the law is very clear that in certain situations, there can be no speeding offence committed.
